Global MSDS Limited (hereinafter “GMSDS”) maintains this website (hereinafter the "ChemReg website") to enhance public access to information about Global chemical regulations.

GMSDS's goal is to keep this information and material timely and accurate, as far as reasonably possible. The information is not necessarily comprehensive, complete, accurate or up to date. If errors are brought to its attention, GMSDS will try to correct them as soon as possible.

Access and use of the ChemReg website involves the full acceptance of the terms and conditions set out below. These terms and conditions are without prejudice to the dedicated terms and conditions applicable to IT tools hosted on other GMSDS websites, including, by way of example, HazMix®.

1. Disclaimer

GMSDS accepts no responsibility or liability whatsoever arising out of, or in connection with, the use of the ChemReg website.

The information that GMSDS provides is publicly available information available from the internet and is not intended to address the specific circumstances of any particular individual or entity; and the information is not provided as professional or legal advice.

Without prejudice to the first paragraph of Section 3 to this Legal Notice, the information, documents, data and databases made available on the ChemReg website, including that provided by third parties, are provided “as is” and without any warranty of any kind, either express, implied, or arising by statute, custom, course of dealing, or trade usage.

GMSDS cannot and does not guarantee that a document available on the GMSDS website reproduces an officially adopted text precisely. In case of disagreement, the text of the Official Journal or, when applicable, the information referred to in Section 3 below shall always prevail.

In all instances, it is GMSDS’s goal to minimise disruption in the use of the ChemReg website caused by technical errors. However, some data or information on the ChemReg website may have been created or structured in fles or formats that are not error-free. GMSDS, therefore, cannot and does not guarantee that its service will not be interrupted or otherwise affected by such problems. GMSDS accepts no responsibility with regard to such problems (e.g., failure of performance, computer virus, alteration of content) incurred as a result of using the ChemReg website or any linked external sites.

Except in cases of fraud or wilful intent, GMSDS shall not be held liable (whether in contract, or otherwise) for any direct, special, indirect, incidental, punitive, exemplary, or consequential damages (including, but not limited to, loss of time, revenues, profits, clients, data), for a decision made or action taken by any party in reliance upon the documents, information and data made available on the ChemReg website, for any interruption of any data, information, or any other aspect of the ChemReg website or for any fraudulent use of the ChemReg website by any third party. If liability may not be excluded by law, it is limited to actual and direct financial loss to the extent it is not caused by proved negligence on the part of the party using the ChemReg website, which may be either on its own behalf or on the behalf of another party and includes, but is not limited to, the purpose of consultation (hereinafter “User”).

This disclaimer applies to the largest extent permitted under the applicable law. However, nothing in this disclaimer is intended to limit the liability of GMSDS in any way or to any extent that contravenes any binding requirements laid down in applicable national law nor to exclude the liability of GMSDS regarding matters in relation to which liability may not be excluded under that law.

2. Limited use of the ChemReg website

The User shall not use the ChemReg website for any reason or purpose which is unlawful, defamatory, harmful, offensive or objectionable in any way nor shall the User transmit to, from or via the GMSDS website, or post on the ChemReg website any material which could be unlawful, harmful, defamatory, offensive or objectionable in any way whatsoever.

3. Information published on the ChemReg website

In addition to the publication of general information related to its products, GMSDS reproduces content from external RSS ('Really Simple Syndication') news feeds.

The User is reminded that the content of these news feeds is the sole property of the RSS provider. GMSDS reserves the right to prevent the distribution of these RSS feeds and GMSDS does not accept any liability for their use.

CAS Information contained in the GMSDS website is the property of the American Chemical Society and any use or redistribution, except as required to fulfil regulatory requirements and/or to produce reports required by national law or administrative policy, is not permitted without the prior written permission of the American Chemical Society.

4. Linking policy

4.1. Links from the ChemReg website to external websites

GMSDS provides links to many European institutions, bodies and agencies as well as to other third-party websites that share its objective. The User should be aware of the following:

If the User accesses another website through a link GMSDS provides, the User is subject to the terms of use and the privacy policy of that website.

GMSDS does not endorse or accept any responsibility for the contents or use of these third-party websites.

If one of the links provided on the ChemReg website is not working, the User may notify GMSDS and GMSDS will rectify the situation as soon as practicably possible.

4.2. Links from external websites to the ChemReg website

GMSDS permits and encourages organisations and individuals to create links to the GMSDS website under the following cumulative conditions:

Links can only be made to webpages that provide a link to this Legal Notice (https://chemreg.net/legal-notice);

Any link to the ChemReg website made on another website should not confuse users of that other website as to the source of the content of the ChemReg website. GMSDS shall be fully acknowledged as the source as provided under this Legal Notice;

When the ChemReg website is accessed via an external link, it shall be clear to users that they are viewing information that is free of charge and not exclusive;

Links should not create the impression that GMSDS endorses or supports the objectives or contents of any

product or service, or of any scientific or administrative output of the information or text in the context of which a link is published;

If links are made from a frames-based website, the contents from the ChemReg website shall not be framed on that website in a way that might mislead users as to the origin of the contents. In such cases, it must also be indicated that the GMSDS website is subject to this Legal Notice (https://chemreg.net/legal-notice).

5. Accreditations

GMSDS does not accredit or endorse companies.

6. Intellectual Property Rights Notice

Some of the information on the ChemReg website is subject to intellectual property rights of third parties (see in particular Section 6.3., Section 6.4. and Section 7. below).

6.1. Use of the information, documents and data from the ChemReg website

Subject to the terms and conditions of this Legal Notice, and subject to other binding limitations provided for under applicable law, the information, documents and data made available on the ChemReg website may be reproduced, distributed and/or used, totally or in part, for non-commercial purposes provided that GMSDS is acknowledged as the source: "Source: Global MSDS Ltd, https://ChemReg/". Such acknowledgement must be included in each copy of the material.

As a general rule, any reproduction, distribution, translation, adaptation, arrangement, alteration and/or any other use of information, documents and data from the ChemReg website carried out in the course of a commercial activity shall require prior written permission from GMSDS. All requests shall be submitted to GMSDS through the ChemReg contact page.

In addition to the above, specific terms and conditions for other uses of materials protected by GMSDS’s intellectual property rights or otherwise may also apply.

6.2. GMSDS's trademarks

GMSDS’s trademarks are its exclusive property. Their use is prohibited without GMSDS’s prior written permission. Requests shall be submitted to GMSDS through the information request forms on the ChemReg contact page.

6.3. Third parties protected materials

The permission mentioned under Section 6.1. does not apply to content provided by third parties, where relevant. Therefore, for material where intellectual property rights are vested in a third party, the User must obtain the necessary permission for reproduction, distribution or any other use from the rightsholder. GMSDS is not in a position to allow or deny reproduction, distribution or use of third-party materials.

In addition to the application of Section 6.5., the reproduction, distribution or further use of information, documents and data contained in the ChemReg website and/or in the GMSDS’s databases may be subject to protection under intellectual property rights, and their utilisation without obtaining the prior permission from the rightsholders(s) of the respective information, documents and data might violate the rights of the rightsholder(s). GMSDS does not accept any responsibility whatsoever, and shall not be held liable, for any copyright or other infringements related to information, documents and data made available via the ChemReg website.

6.4. GMSDS's databases

GMSDS holds exclusive rights in relation to the use, the reproduction and the making available to the public of the whole or a substantial part of the databases made available on the ChemReg website (a database is to be construed as a collection of independent works, data or other materials arranged in a systematic or methodical way and individually accessible by electronic or other means). The content of the databases may also be subject to pre-existing rights of third parties (see Sections 6.3. and 7.).

The replication, in whole or in substantial part, of the GMSDS databases is prohibited, unless GMSDS’s prior written permission is given. All requests shall be submitted to GMSDS through the ChemReg contact page.

6.5. Download of materials

Certain materials may be made available for download from the GMSDS website such as search results and regulations. Subject to the terms and conditions of this Legal Notice, and in particular Section 6.1., GMSDS grants the User permission to download and copy such materials, provided that:

GMSDS is acknowledged as the source: "Source: GMSDS, https://ChemReg/". Such acknowledgement appearing on the originals must be included in each copy of the material;

The User does not do anything that would harm the integrity of the materials in any way; and

The User does not replicate databases of the downloadable materials in full or in any part, unless written permission is given (see Section 6.4.).

Without limiting any other right or remedy available to GMSDS, the permission herein granted shall automatically terminate in the event the User breaches any of the terms of this Legal Notice and, in such event, the User must destroy immediately all downloaded materials in its possession.

7. Third Parties protected materials (other than by intellectual property rights)

In addition to Sections 6.3. and 6.4., third parties materials made available on the ChemReg website may be protected by rights other than intellectual property rights. Therefore, for materials where other rights are vested in a third party, the User must obtain the necessary permission for reproduction, distribution or any other use from the rightsholder.

GMSDS is not in a position to allow or deny reproduction, distribution or use of third party materials. GMSDS does not accept any responsibility whatsoever, and shall not be held liable, for any violation of any such kind of rights related to information, documents and data made available via the ChemReg website.

8. Personal data protection

GMSDS is committed to the User's privacy.

8.1. Internet privacy policy

The data controller collecting the data described herein is GlobalMSDS Ltd, the UK registered company. Personal data collected by GlobalMSDS Ltd may be transferred to other associated firms, where it is necessary to meet the purpose for which the visitor has submitted the information. By submitting data on the ChemReg website, the visitor is providing explicit consent to transborder transmission of data collected on the website for the fulfilment of their voluntary requests.

8.2. Data collection

We collect only personally identifiable information that is specifically and voluntarily provided by visitors to ChemReg website. GlobalMSDS Ltd receives limited identifiable information, such as name, Title, company address, email address, and telephone and fax numbers, from website visitors. Typically, identifying information is collected to:

  • Register for certain areas of the site
  • Inquire for further information
  • Distribute requested reference materials

Demographic information, including gender and occupation, is not actively sought. It is GlobalMSDS Ltd policy to limit the information collected to only the minimum information required to complete a visitor's request. In any instance where non-mandatory information is sought, the website visitor will be notified of this at the point of collection.

If visitors are able to send email through the site. Their messages will contain the user's screen name and email address, as well as any additional information the user may wish to include in the message. Because we use the website as a recruiting tool, a visit to the website may also result in the user sending a resume to an individual within GlobalMSDS Ltd.

GlobalMSDS Ltd intention is not to seek any sensitive information through our website unless legally required. Sensitive information includes a number of types of data relating to: race or ethnic origin; political opinions; religious or other similar beliefs; trade union membership; physical or mental health; sexual life or criminal record. We suggest that you do not provide sensitive information of this nature. If you do wish to provide sensitive information for any reason, GlobalMSDS Ltd accepts your explicit consent to use that information in the ways described in this privacy statement or as described at the point where you choose to disclose this information.

8.3. Use of data

A user may choose to provide personal information in the following examples:

  • Order publications
  • Participate in "join our mailing list" initiatives
  • Participate in bulletin boards, discussion or message forums
  • Contact us for further information
  • Registration at https://www.hazmix.com
  • Register for premium online services

 

If you would like to find out more about the different categories of information collected, please review the data collection section. Information attained by the site is used only for the intended purpose stated at the time that the information is collected. This data is not shared with other entities in the network for secondary or unrelated purposes, or shared with a third party, unless otherwise disclosed at the point of collection. If there is an instance where such information may be shared, the visitor will be asked for permission beforehand. GlobalMSDS Ltd makes every practical effort to avoid excessive or irrelevant collection of data. If a visitor believes the site has collected excessive information, we encourage the visitor to contact us at solutions@globalmsds.co.uk to raise any concerns.

Except for the mailing list initiative described above, where visitors explicitly choose to receive specific GlobalMSDS Ltd marketing or other materials, GlobalMSDS Ltd will not use personal data collected from our websites to facilitate unsolicited marketing activities.

8.4. Cookies and log files

Cookies may be used on some pages of our site. "Cookies" are small text fles placed on your hard drive that assist us in providing a more customised website experience. For example, a cookie can be used to store registration information in an area of the site so that a user does not need to re-enter it on subsequent visits to that area. It is GlobalMSDS Ltd policy to use cookies to make navigation of our websites easier for visitors and to facilitate effcient registration procedures. Site statistics are compiled by third parties, and therefore your IP address will be passed to third parties for statistical reporting only.

If you are concerned about cookies, most browsers permit individuals to decline cookies. In most cases, a visitor may refuse a cookie and still fully navigate our websites, however other functionality in the site may be impaired. After termination of the visit to our site, you can always delete the cookie from your system if you wish.

In order to properly manage our website we may anonymously log information on our operational systems, and identify categories of visitors by items such as domains and browser types. These statistics are reported in the aggregate to our webmasters. This is to ensure that our website presents the best web experience for visitors and is an effective information resource.

8.5. Third parties

It is GlobalMSDS Ltd policy only to disclose information to third parties under the following circumstances:

  • As required by law through the correct legal process
  • When explicitly requested by a visitor
  • When required to deliver publications or reference materials requested by a visitor GlobalMSDS Ltd policy is not to disclose information to third parties.

GlobalMSDS Ltd websites do not collect or compile personally identifying information for dissemination or sale to outside parties for consumer marketing purposes, or host mailings on behalf of third parties. Third party links

There are several places throughout GlobalMSDS Ltd that may link to other websites that do not operate under GlobalMSDS Ltd privacy practices. When you link to other websites, GlobalMSDS Ltd privacy practices no longer apply. We encourage visitors to review each site's privacy policy before disclosing any personally identifiable information.

8.6. Data retention

Some of the information we receive is retained. For example, we usually do keep addresses such as information generated though registration for access to areas on the site, this will be kept as long as the information is required to completely service the contact request or until a user requests that we delete that information. Mailing list information, discussion posts and email are kept for only the period of time considered reasonable to facilitate the visitor's requests.

8.7. Choices

As a policy, visitors are required to register to gain access to areas of the GlobalMSDS Ltd websites. In certain cases in the future, as your GlobalMSDS Ltd website experience expands, we may require visitors to do an additional register in order to obtain a user-id and password for authentication and secure access to a transaction or certain business confidential or proprietary information services. Personally identifiable information provided to GlobalMSDS Ltd through its websites is provided voluntarily by visitors. Should visitors subsequently choose to unsubscribe they can contact us on solutions@globalmsds.co.uk.

8.8. Access

Each visitor has the right of access to personal data they have submitted through the websites to GlobalMSDS Ltd. User updates of information should be handled by going back through the registration process. Inquiries about the accuracy of identifying information previously submitted to GlobalMSDS Ltd through its websites, or requests to have outdated information removed, should be directed to solutions@globalmsds.co.uk. GlobalMSDS Ltd is committed to providing reasonable and practical access to visitors to allow them the opportunity to identify and correct any inaccuracies. When requested and practical, GlobalMSDS Ltd will delete identifying information from current operational systems. When personally identifiable information is retained, GlobalMSDS Ltd assumes responsibility for keeping an accurate record of the information once a visitor has submitted and verified the data. GlobalMSDS Ltd does not assume responsibility for verifying the ongoing accuracy of the content of personal information. When practically possible, if GlobalMSDS Ltd is informed that any personal data collected through a website is no longer accurate, GlobalMSDS Ltd will make appropriate corrections based on the updated information provided by the authenticated visitor.

8.9. Security

GlobalMSDS Ltd has implemented generally accepted standards of technology and operational security in order to protect personally identifiable information from loss, misuse, alteration or destruction. All GlobalMSDS Ltd employees follow a network-wide security policy. Only authorised GlobalMSDS Ltd personnel are provided access to personally identifiable information and these employees have agreed to ensure confidentiality of this information. GlobalMSDS Ltd policy is to use secure socket layer technology for the protection of credit card information submitted through web forms. This policy is also required for any fulfilment agents of our firms.

8.10. Children

GlobalMSDS Ltd understands the importance of protecting children's privacy especially in an online environment. The GlobalMSDS Ltd sites covered by this privacy statement are not intentionally designed for or directed at children 13 years of age or younger. It is GlobalMSDS Ltd policy never to knowingly collect or maintain information about anyone under the age of 13.

8.11. Modifications

GlobalMSDS Ltd reserves the right to modify or amend this Statement at any time. The effective date will be displayed at the end of this statement. For any general enquiry relating to the overall privacy policy of the ChemReg website, the User may contact GMSDS via the information request forms on the ChemReg contact page.

9. Systematic data collection

Systematic automated data collection activities (including scraping, data mining, and extraction and re-utilisation) of the whole or a substantial part of the ChemReg website and the GMSDS databases are prohibited.

10. Miscellaneous

10.1. Breach of the terms and conditions of the Legal Notice

Failure to comply with the terms and conditions of this Legal Notice may have consequences for the User, including, but by no means limited to, the User being prohibited from accessing the ChemReg website, other websites, databases and services provided by GMSDS Ltd by blocking the User's IP address.

Any User may also be held liable for any damage to the ChemReg website or for any damage resulting directly or indirectly from the impairment of the availability or accessibility of the ChemReg website caused by the User’s actions.

10.2. Applicable law, and dispute settlement

The terms and conditions of this Legal Notice are administered and interpreted in accordance with the applicable laws of England and Wales. In any action brought by Company or Client to enforce or otherwise arising out of this Agreement, Client hereby agrees that it is subject to the jurisdiction of England and Wales. The unenforceability of any provision of the Agreement in a specific situation shall not affect the enforceability of that provision in another situation or the remaining provisions of the Agreement.
